Haidian district court rejected a divorce request filed by a gay man surnamed Wang, as it is still too soon after his lesbian wife gave birth, the Beijing Evening News reported.
Wang and his wife, surnamed Zhang, married and agreed to have twins using artificial means in 2010. They would each take one child.
Wang filed for divorce after Li gave birth to only one child and refused to let Wang raise him. Li did not agree, as the child was still too young.
A husband is not allowed to file for divorce during his wife's pregnancy and within one year after the delivery, according to the Marriage Law of China.
