Man wins lawsuit after taking firework flak

Pudong New Area District People's Court has ordered a local branch of the Postal Savings Bank of China to pay 16,500 yuan ($2,709) to a 65-year-old man who was injured by a falling piece of firework debris during the branch's opening ceremony, the court said Tuesday.

The plaintiff, surnamed Dong, got hit in the left leg while passing by the branch as employees were setting off fireworks to celebrate its grand opening on July 30, 2011, according to a court press release.

The bank paid Dong 2,400 yuan to cover his initial medical expenses. However, Dong ended up going back to the hospital several times for additional treatment.

The bank refused to pay more, though it never disputed that it was responsible for Dong's injury. It only took issue with the amount of compensation he wanted.

Dong sued the bank in July for 150,000 yuan to cover his additional medical expenses and compensate him for his emotional distress.

The court determined that Dong did not deserve compensation for emotional distress because he didn't suffer serious harm, such as a chronic disability. Nonetheless, the court ruled that the bank owed him restitution for his additional medical bills and other expenses.
