The Guangdong High People's Court on Friday ruled that JDB Group has infringed on Guangzhou Pharmaceutical Holdings's rights by using a disputed red can package for its herbal tea products.

JDB was ordered to compensate Guangzhou Pharmaceutical 150 million yuan ($24.11 million) for economic losses and 260,000 yuan for legal fees. JDB will appeal, it said in a statement on its website on Friday.

The case was referred to as "the first case of product packaging in China."

Guangzhou Pharmaceutical granted JDB the Wong Lo Kat trademark in 1995, but the authorization ended in 2012. Now both companies produce herbal tea in red cans.
