Dutch chip maker Nexperia's Chinese parent company Wingtech Technology on Thursday said that the Dutch Ministry of Economic Affairs took the first step in properly handling the issue by suspending the administrative order, and urged the Dutch side to face up to the essence of the Nexperia issue and to swiftly and fully correct its mistake, stressing that it should ensure that the status of Nexperia returns to that before September 29.
As of the press time on Thursday night, the Nexperia issue caused by the Dutch side has still not been solved, the company said.
The response came after the Dutch side just on Wednesday said that it was suspending its intervention in Nexperia after what it said were constructive meetings with China. However, despite the announcement, the relevant order remains in effect and is not affected by the suspension, Wingtech said in a statement posted on its official WeChat account.
Although the administrative order has been suspended, the emergency measures issued by the Enterprise Chamber of the Amsterdam Court of Appeal have not been lifted, and the restrictions and infringements on the lawful rights of the Chinese shareholder and personnel remain in effect, the statement noted.
By merely announcing the suspension of the administrative order, the Dutch Ministry of Economic Affairs has sidestepped the erroneous decision made under its influence through which the Enterprise Chamber stripped Wingtech of its control over Nexperia, Wingtech said, adding that this approach fails to address the crux of the issue.
The statement further stressed that the Dutch side should not only permanently revoke the administrative order issued under the Goods Availability Act targeting Nexperia and withdraw its participation and support before the Dutch Enterprise Court, but also ensure that the Chinese shareholder's lawful control and the legitimate rights of Chinese personnel are restored, bringing Nexperia back to the status it held before September 29, 2025.
"Any genuine solution must be based on restoring Wingtech's full shareholder rights and its lawful control over Nexperia," the company said.
Wingtech added that it will never accept any attempt to "legalize" an unlawful outcome, nor accept a corporate governance or equity "new normal" created through illegal procedures. The company vowed to take all legal measures necessary to safeguard the lawful rights and interests of the company and all its shareholders.
China has repeatedly urged the Dutch side to match its words with actions regarding the Nexperia issue, take concrete steps as soon as possible to safeguard the stability of the global semiconductor supply chain, and bear full responsibility for the consequences.
The Chinese side welcomes the Dutch government's move to suspend its administrative order regarding semiconductor manufacturer Nexperia, but it still falls short of completely resolving the issue, He Yongqian, a spokesperson for China's Ministry of Commerce (MOFCOM) said on Thursday, urging the Dutch side to show sincerity and take concrete action to push for early resolution of the Nexperia issue.
He Yongqian made the comments in responding to a question seeking more information on a Dutch government delegation's Beijing visit earlier this week to seek a solution in the Nexperia issue.
"I want to emphasize that the root cause and responsibility for the current global semiconductor supply chain disruptions lie with the Dutch side," He said.
"This is the first step toward the right direction of appropriately solving the issue, but it still falls short of completely resolving the issue," the spokesperson said, urging the Dutch side to continue to show sincerity for cooperation and take concrete actions to swiftly and effectively solve the issue surrounding Nexperia and ensure security and stability of global semiconductor chains.
